Bewertung: Die IP-Praxis der Wiener Kanzlei ist eine der hartnäckigsten Herausforderinnen der österreichischen Marktführer im Marken- und Wettbewerbsrecht. Patentprozesse Spielen bei der Kanzlei traditionell im Vergleich zum Soft-IP eine geringere Rolle. Dennoch hat sie auch hier einen guten Ruf und vertritt derzeit mit Magna eines der bekanntesten österreichischen Unternehmen. Allerdings musste gerade die Patentpraxis einen Dämpfer hinnehmen. Die Kanzlei hatte die patentrechtliche Arbeit zuletzt stark auf Thomas Adocker konzentriert, der etwa in mehreren Verfahren für Sandoz zugegen ist. Er wechselte im April 2023 zu Taylor Wessing, und seine wichtigste Mandantin Sandoz folgte ihm zur Konkurrenz. Schwarz Schönherr muss nun seine Patentpraxis neu sortieren. Um ihre Chancen für UPC-Verfahren zu wahren, wird die Kanzlei engere Verbindungen mit gleich positionierten Kanzleien in anderen UPC-Ländern eingehen müssen. Zuletzt nahm die Beratung zu urheberrechtlichen Fragen zu, etwa für einen Hersteller von Spielzeugen, der über eine Berliner Kooperationskanzlei zu Schwarz Schönherr kam. Dies zeigt, wie gefestigt die Beziehungen der IP-Praxis zu zahlreichen informellen Partnerkanzleien in den Nachbarstaaten sind.
